Terms
The agreement between you and BRAMCO BV governing your use of Ridden.
1. Parties and acceptance
Ridden is operated by BRAMCO BV, a company incorporated in Belgium ("Ridden", "we", "us"). Our full particulars appear in the legal notice. By accessing or using the service you agree to these terms. If you do not agree, do not use the service.
These terms apply together with our privacy policy, which governs the processing of personal data.
2. The service
Ridden identifies which climbs in our catalog you have ridden and indicates when a professional cycle race is scheduled to climb one of them. Where you arm a reminder, the service delivers two alerts for that climb: one on the evening before, and one approximately 35 minutes before the race is predicted to reach it.
3. Eligibility
You must be at least 13 years of age to use the service. Where you connect a Strava account, you must comply with Strava's own terms, and you warrant that you are entitled to connect that account.
4. Accuracy, and the absence of any guarantee
The service provides estimates. It does not provide guarantees, and you should not rely on it where the consequences of an inaccurate prediction matter to you.
Times are estimates. Predicted times are derived from the race organiser's published roadbook, which states expected times at each point for three riding speeds. We adopt the middle speed as the expected time and present the outer speeds as a window. This is a projection and not a schedule.
Races ignore roadbooks. Breakaways, weather, crashes, neutralised sections and shortened stages all displace the peloton, on occasion by more than the whole predicted window. We adjust timings during a race where we are able to, but we observe the same race you do and have no privileged information.
Broadcast listings change. Channels, coverage times and territorial availability are determined by broadcasters and rights holders, not by us. Listings are indicative only.
Delivery is not guaranteed. Alerts are transmitted through third-party infrastructure, including browser vendors' messaging services and email providers. We queue and dispatch each alert at the scheduled time but cannot warrant that it is received or displayed.
To the extent permitted by law, the service is provided on an "as is" and "as available" basis, and we do not warrant that it will be uninterrupted or error free.
5. Accounts
An account is created against an email address, which must be confirmed. Access is by password or by a single-use sign-in link. You are responsible for maintaining the confidentiality of your credentials and for activity conducted through your account.
A Strava account may be attached to your Ridden account in order to match your rides. A Strava athlete may be attached to only one Ridden account. You may detach Strava at any time in settings, and your Ridden account continues to exist if you do. You may request deletion of the account at any time; the privacy policy sets out the consequences.
Data shown in your account is your own. We do not disclose one user's ride-derived data to another user.
6. The Ridden Pass
The Ridden Pass is a paid subscription that unlocks predicted timings, broadcast information and alerts, and removes the limit on your climb collection. It is offered on a yearly or monthly basis.
The pass covers the professional road racing calendar as covered by us at the time of purchase, as described at checkout. Coverage may be extended during a subscription period. Where coverage is to be reduced, we will give notice before the start of the season concerned.
Prices, the applicable currency and any tax are displayed at checkout and are inclusive of tax where tax applies in your jurisdiction.
7. Buying and billing
Paddle.com Market Ltd ("Paddle") acts as merchant of record for all sales of the Ridden Pass. Your purchase contract for the transaction is concluded with Paddle and not with BRAMCO BV. Paddle collects payment, determines and remits applicable taxes, issues invoices and administers chargebacks. We do not receive or store payment card details.
Invoices, stored payment methods, renewal dates and cancellation are administered through Paddle's buyer portal, linked from every receipt Paddle issues and from settings within the application. For any matter concerning a payment, begin at paddle.net.
Charges may appear on your statement under Paddle's name rather than ours. This is not indicative of an unauthorised transaction.
8. Renewal and cancellation
Subscriptions renew automatically at the end of each subscription period, yearly or monthly as selected, until cancelled. Advance notice of a yearly renewal is sent by email, stating the amount and the date.
You may cancel at any time through the buyer portal. Cancellation takes effect at the end of the period already paid for, and access continues until that date. No further sum is charged after cancellation.
9. Statutory withdrawal right
Where you contract as a consumer in the European Union, you have a period of 14 days in which to withdraw from the contract without giving a reason. In the case of digital services supplied immediately, you are asked at checkout to consent to immediate performance and to acknowledge that the withdrawal right is lost once the service has been fully performed.
10. Refunds
Inside 14 days of a payment we refund it, no questions asked. A request may be made to us or to Paddle, no reason is required, and the extent to which the period has already run is immaterial. This applies equally to a renewal charge.
After 14 days, sums paid for the remainder of a subscription period are not ordinarily refundable. We will nonetheless refund where you have been charged twice, where you have been charged following cancellation, or where the service has been materially unavailable for an extended period.
Nothing in this clause restricts your statutory rights, including the withdrawal right at clause 9 and rights under applicable national consumer law, which apply in addition.
Complimentary passes are issued without payment and without invoice, and no sum is refundable in respect of them. A complimentary pass expires on the date stated when it is granted.
Payment queries may be addressed to bram@ridden.io, stating the date and amount, or directly to Paddle support through the buyer portal.
11. Intellectual property
The Climb Catalog, the timings we derive, the editorial text, the design, the Ridden name and the climb mark are our property or are licensed to us. You are granted a personal, non-exclusive, non-transferable right to use the service and to share the cards it generates for you. You may not copy or extract the catalog or the timings, scrape the service, or resell any part of it.
Race and event names are used descriptively, to identify which event climbs which road. We use no race logos, typefaces or imagery, and Ridden is not affiliated with ASO, RCS Sport, Flanders Classics, the UCI, or Strava. Those marks remain the property of their owners.
Your ride data remains yours. We retain only our own record of which catalog climbs you have ridden, and use it to compose your alerts and render your collection.
12. Acceptable use
You must not attack, disrupt or attempt to gain unauthorised access to the service, scrape it, resell access to it, or use it to collect the personal data of others. We may suspend or terminate an account in breach of this clause. Where we terminate a paid account for breach, no refund is due. Where we terminate for any other reason, we refund the unused portion of the period paid for.
13. Liability
We provide the service with reasonable skill and care. Subject to the paragraph below, our total liability arising out of or in connection with these terms is limited, in aggregate, to the amount you paid us in respect of the current subscription period, or fifty euro where you have paid us nothing.
We are not liable for indirect or consequential loss, or for loss arising from reliance on a predicted time, a broadcast listing, or the delivery of an alert.
Nothing in these terms excludes or limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or your rights as a consumer under Belgian and European Union law, which apply in addition to these terms.
14. Changes to these terms
We may amend these terms. Where an amendment is material to you, we will give notice in the application or by email at least 30 days before it takes effect, and you may cancel and receive a refund of the unused portion of the period paid for.
15. Term and termination
You may stop using the service and delete your account at any time. We may terminate this agreement on 30 days' notice, or immediately in the case of material breach, refunding the unused portion of any period paid for.
16. Governing law and disputes
These terms are governed by Belgian law and the courts of Belgium have jurisdiction. Where you contract as a consumer, this does not deprive you of the protection of the mandatory law of your country of residence, and you may bring proceedings there.
Because Paddle is the merchant of record, a dispute concerning a purchase should be raised with Paddle in the first instance. For a dispute with us, the Belgian Consumer Mediation Service (Consumentenombudsdienst) provides an out-of-court route. The European Commission also operates an online dispute resolution platform for consumers.
